Terms and Conditions

BUYER'S PREMIUM: 20% ON FIRST $1,000 THEN 10% UP TO $25,000 THEN 2.5% ON THE REMAINING BALANCE

We will offer for sale by auction ("The Auction") of items ("Items") either singularly or in groups ("Lot").

It is agreed that each Bidder Number/Username is unique and non-transferable.

Bidders are to be held personally liable for any bids made with their Bidder Number.

Applicable State Sales Tax will be charged on all Lots. Bidders will be exempt from Sales Tax if they provide proof an approved tax exemption status form and exception certificates that are acceptable to the said State.

The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute JJ Merchant shall have absolute discretion either to settle such dispute or re-offer the lot for re-sale. JJ Merchant accepts no liability for loss or damage howsoever arising from any Lots not presented for sale.

Payment in full must be made directly to auctioneer/seller in the form Cash, Wire Transfer, or Cashier’s Check within 3 days. NO EXCEPTIONS!

All purchases must be removed from the premises as specified by the auction Terms & Conditions.

Failure to do so will result in storage fees and transportation fees if such purchases need to be moved to another location.

JJ Merchant will use every endeavor to ensure that all Lots appearing in the catalog for sale ("The Catalog") are presented for sale at the Auction. JJ Merchant accepts no liability for loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale.

JJ Merchant has described the Lot(s) in the catalog to the best of their ability and belief from information furnished by the Seller(s). JJ Merchant undertake no liability whatsoever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. JJ Merchant reserves the right to bid on behalf of the consignor. Any intending Purchaser must satisfy himself by inspection or otherwise as to the correctness of each such statement.

Each and every Lot is sold “as is, where is”. The Auctioneer provides no guarantees or warranties (express or implied) in respect of the item contained in the Lot. All representations made by JJ Merchant, its servants or agents are to be considered lay opinions only and the JJ Merchant accepts no liability for any purchase made by a Buyer in reliance upon them.

The Buyer of a Lot is deemed to have inspected the item contained in that Lot prior to purchase.

Upon the receipt of cleared funds from the Buyer, the Buyer agrees to remove the Lot purchased from the Sale Site forthwith unless otherwise agreed in writing by the JJ Merchant.

The Buyer agrees to insure the Item purchased against all losses from the Auction Date until removal of the Item by the Buyer. The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth.

JJ Merchant is not responsible for any item(s) condition (cosmetic or mechanical) left on our lot, before or after the auction.  

JJ Merchant is not responsible for the condition (cosmetically or mechanically) of any items/lots that previous winning bidders have chosen to store at our location or request that JJ Merchant resell/rerun in future auctions from when the items/lots were won! 

Guaranty Waiver. All property is offered for sale “AS IS, WHERE IS.” (Seller) makes no warranty, guaranty, or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.  

Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property and must be made within 3 business days upon completion of the end of the current auction. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.

JJ Merchant reserves the right to revoke a Bidder Number at any time.

NOTICE: If you are the winning bidder and default by failing to adhere to this sellers’ terms and conditions your account with JJ Merchant WILL BE LOCKED!!
